wierd stuff installing Monterey, over (formatted) patched sur

Ive been running patched sur forever, but the machine has been acting wierd as of late and decided to take the jump to a modern(ish) patched OS.

install went without a hitch, but migration from the original patched sur time machine has been an absolute train wreck.

problem one, endless bootloop after migration tool is finished. Broke out of this by booting into safe mode twice.

problem two, despite spending 2h copying files from the time machine, there are no files on the os. None of my documents, download, desktop, nada.

it could be that for whatever dumb reason time machine decided to backup the empty state of the new machine and is installing the files then deleting them to reflect the empty backup state. IDK. Im utterly baffled at this point.

is there a way to migrate from a known good backup date/set?

if that isnt the answer maybe i need to install oclp big sur then upgrade from there?

How does one migrate from patched sur to oclp without losing files?
